Section 1331, 1332, and 1338. The amount in controversy between the parties exceeds $75,000. Venue is propoer in this judicial district pursuant to 28 US.C. Section 1400(b) and 1391(c). This Court has jurisdiction over Ceragem and the Ellaen Defendants. Ceragen and the Ellaen Defendants have entered into a Settlement Agreement providing for the entry of this Consent Judgment (see document for further details.) Any failure by the Ellaen Defendants to comply with this Order shall cause irreparable injury to Ceragem, and Ceragem shall be entitled to obtain a temporary restraining order and permanent injunctive relief to enjoin such violations upon an expedited hearing. Ceragem shall be entitled to the issuance of such an injunction upon the posting of a bond in the amount of no more than $1,000. The Court shall retain jurisdiction over the Ellaen Defendants to enforce the terms of this Consent Judgment. Ceragem claims against the Ellaen Defendants are hereby dismissed without prejudice.
